Town Council Meeting – Thursday, April 4, 2024

The April 4, 2024 Meeting of the Barnstable Town Council was conducted in person. The public was able to attend in person or participate remotely in Public Comment or during a Public Hearing via Zoom. The public was able to view the meeting on Barnstable Government Access Xfinity Channel 8 or 1070 or in High Definition on Xfinity Channel 1072 or via the live stream through the Town website. Town Council President Felicia Penn called the meeting to order and Assistant Town Clerk Janet Murphy took the Roll Call.

 

Town Council Vice President Craig Tamash introduced Major Greg Quilty who honored Vietnam Veteran Carl Phillips who was supposed to lead the Pledge of Allegiance. Long time Barnstable resident and retired Air Force Master Sergeant Carl Phillips is going to be 90 years old this year. Master Sergeant Phillips served in active duty honorably for over 20 years in the U.S. Air Force. He entered the service on June 18, 1963. He retired on January 31, 1974. He served throughout the Vietnam war in the tumultuous 1960’s. Something that was very difficult for a military person of color at that time.  He served as an airborne combat medic during Vietnam. He received the Air Medal, one of the highest decorations possible for airborne personnel – usually awarded to pilots. He received numerous other awards and decorations. He had the difficult and harrowing job of being lowered by helicopter, under fire, to tend to, rescue, and evacuate wounded soldiers and marines caught behind enemy lines. An airborne combat medic is exposed to great risk and the selfless task of saving our wounded on the battlefield. He saved countless lives on over 50 clandestine missions behind enemy lines one of which reads in part, “Staff Sergeant (his position at the time) Phillips distinguished himself with heroism while participating in aerial flight in Southeast Asia 27 July 1965. On that date, Staff Sergeant Phillips was flying in an unarmed medevac helicopter on a highly important rescue mission. The flight was conducted under adverse weather conditions and in executing his mission, Staff Sergeant Phillips was exposed to over 4 hours of continuous hostile fire. He executed his mission flawlessly with professional skill and reflected great credit upon himself and the United States Air Force.

 

President Penn offered a Moment of Silence and asked that we remember those near and dear to you.

 

Governor’s Youth Advisory Council Presentation – State Representative Kip Diggs; Youth Commission members: Piper Hunt (via Zoom) and Laik O’Reilly. The Governor selected 60 young adults statewide and the Town of Barnstable is pleased to have two outstanding representatives. Both Piper and Laik read the essays they submitted in application to the Governor’s Youth Advisory Council. Piper and Laik received Standing Ovations for their efforts.

 

Town Attorney Karen Nober was invited to the podium to explain the ground rules on Public Comment as stated in the Town Council Rules.

President Penn announced that Mr. Ells’s Town Manager Communications for the period of March 20 – April 2, 2024 had been pre-recorded and was shown on our Government Access Channel prior to the meeting.   1. This is a reminder to residents who are registered voters that might be interested in serving the Town of Barnstable as the Cape Cod Commission representative to submit a letter of interest to the Town Manager by April 5, 2024, for consideration. Cape Cod Commission members are citizen volunteers who receive and evaluate information from the Cape Cod Commission’s professional staff, consider policies to guide the agency’s activities, and make regulatory decisions about development proposals under the agency’s jurisdiction. The next appointment of a three-year term will commence on April 24, 2024.  Thank you for your consideration of this volunteer position.

 

  1. We are proceeding with the budget action calendar for FY 2025. A public fee hearing was held on March 19, 2024 and the proposed changes to FY 2025 fees are posted on the Town website and comments will be accepted through April 19, 2024.  The FY25 proposed capital program and FY25 to FY29 Capital Plan has been submitted to the Town Council and is available on the town’s website for viewing. Finance Director Milne will provide an overview of the proposed FY25 CIP at the April 4 Town Council meeting and CFAC will provide an overview of their report.  Public hearings on the Capital Improvements Plan (CIP) orders are scheduled to begin April 25, 2024.   The School Committee held a public hearing on the proposed FY25 school department operating budget on March 20, 2024.  A copy of the proposed budget is available on the school’s website. The School Committee is expected to vote on the proposed budget at their April 3, 2024 meeting.  For information on our fiscal year budgets please view the Town’s Open Budget website at http://budget.townofbarnstable.us.

 

  1. As previously reported and in response to requests by Town Council and the public regarding monitoring the activation of the Vineyard Wind cable landing at Covell’s Beach, I continue discussions with Vineyard Wind and requested regular communication with Barnstable Officials and our public regarding the safe and compliant operation of their system. Vineyard Wind is developing informational signage to be installed at the site to illustrate location and other project information so that those who visit Covell’s Beach may have access to such information.  The informational signage will be installed in Spring 2024.  They are preparing a means of public access to information regarding issues of concern such as Electromagnetic Frequency (EMF) as well as other safety compliance aspects so that the public will know that the system is functioning in a safe and compliant manner.  The Town of Barnstable has met with an independent third-party expert to assist in verifying such safety issues.  We will keep you informed of the progress on this matter.

 

  1. Since our presentation on Groundwater 101, I have received several questions from the public as to whether the Town has concerns about existing and proposed substations relative to water resource protection. My response has been that all land uses in Barnstable are of concern because we live on top of our water resources.  In the case of electrical substations, we are absolutely concerned and continue to try to understand the potential impacts of such a land use as the Town of Barnstable does not approve such uses.  The Commonwealth of Massachusetts under its Executive office of Energy and Environmental Affairs Department of Public Utilities Energy Facilities Siting Board (EFSB) issues such approvals.  Most recently, we have identified the need for additional information related to the proposed expansion of the Oak Street Substation (Mid Cape Reliability Project) in an effort to better understand the potential down gradient impacts of a release from said substation and await review by the EFSB regarding that request for information.  We plan to share additional information on water resource management planning with the Secretary of Energy and Environmental Affairs (EEA) regarding ongoing efforts in Barnstable, specifically in West Barnstable.

 

A second question focuses on, who is the compliance officer for the wind and substation projects?  We know that the Town does not have authority in this area and the information below will point inquiries in an appropriate direction.  For now, we suggest the following for safety and compliance issue:

 

  1. If the inquiry concerns VW, PCW or the Eversource West Barnstable substation (Mid Cape Reliability) and its safety and compliance with its EFSB/DPU siting decision, we suggest that the person is referred to the EFSB. They can email their concern to Andrew Greene, Director at the EFSB, at Greene@mass.gov and perhaps copy DPU.efiling@mass.gov. We think copying the DPU filing room may be helpful because the EFSB/DPU may be more likely to respond to a concern that lands on the public docket. In order to make sure that their email gets filed properly if they copy the DPU filing room, they would need to add the EFSB docket number as part of what they write in the email’s subject line.
    1. For Mid-Cape Reliability, the docket number is EFSB 19-06A, for Park City Wind it’s EFSB 20-01, and for Vineyard Wind it’s EFSB 17-05.

 

  1. If the inquiry concerns whether a substation is complying with applicable law or may have an unsafe condition, we suggest the person email the DPU at Legal@mass.gov and DPU.Adminstration@mass.gov.

 

We plan to request direct contact information for safety and compliance officer(s) from the Secretary (EEA) in our continued efforts to insure safe and compliant projects.

 

  1. On March 28, 2024, the Town of Barnstable received notice from the Cape Cod and Islands Water Protection Fund Management Board (Management Board), pursuant to its authority under M.G.L. c. 29C, §§ 19 and 20 and through the Cape Cod Commission, notifying Barnstable that the Management Board, at its meeting on March 22, 2024, voted to approve contingent commitments for subsidies from the Cape Cod and Islands Water Protection Fund (CCIWPF) to fund Qualified Projects listed on the 2024 Clean Water State Revolving Fund Intended Use Plan (IUP). These commitments represent a 25% principal subsidy for eligible projects. On March 26, 2024, The Massachusetts Department of Environmental Protection announced the Final 2024 Intended Use Plans (IUPs) detailing the projects, borrowers and amounts that will be offered financing through the Clean Water and Drinking Water State Revolving Fund loan programs for this year’s financing cycle.  Barnstable’s 2024 (proposed FY 2025 projects) projects received eligibility and therefore are eligible for the 25% principal subsidy from the CCIWPF referenced above.  You may access the IUPs by visiting MassDEP’s website at:

It should also be noted that the action by the Management Board, though subject to annual approval, anticipates a 25% principal subsidy for eligible projects into the foreseeable future.  We will keep you advised as we progress on this matter.

President Penn announced that there will be a Special Town Council Meeting on Thursday, April 11th at 6:00 PM. This will be the second special meeting on water and the topic is PFAS. Same rules apply and no public will be admitted because of the capacity of the Hearing Room. Motion for reconsideration of the following vote of the Town Council on March 21, 2024:

The first vote was to suspend Town Council Rule 6F to allow a motion for reconsideration of their March 21st vote to suspend Town Council Rule 11A as it related to the appointment of registered voters by the Town Council President to the committees set forth in Agenda Item 2024-166 to be made at last night’s meeting by any Councilor.

The vote passed.

 

The second vote was to approve a motion for reconsideration of the March 21st vote to suspend Town Council Rule 11A as it related to the appointment of registered voters by the Town Council President to the committees set forth in Agenda Item 2024-166.

The vote passed.

 

The third vote was a re-vote of the March 21st vote. To suspend the provisions of Town Council Rule 11A as it relates to the appointment of registered voters by the Town Council President to the ad hoc committees set forth in Item No. 2024-166, in order that such appointments shall be made by vote of the Town Council after recommendation from the Appointments Committee by May 1, 2024.

The vote passed 7-6.

 

OLD BUSINESS

AGENDA ITEM 2024-171 Order authorizing an Intermunicipal Agreement among the Towns of Barnstable, Yarmouth, and Sandwich for the purposes of establishing a regional emergency communications center hosted by and located within the Town of Barnstable.

Presented by Police Chief Jean Challies and Hyannis Fire Chief Peter Burke. Vice President Tamash commended Chief Challies, Assistant Town Manager Andy Clyburn, and Chief Burke for their efforts to move this forward. The item was approved.

 

AGENDA ITEM 2024-172 Amending the Code of the Town of Barnstable, Part I General Ordinances, Chapter 1 General Provisions, Article I Non-Criminal Enforcement of violations, and inserting a new Chapter 185 known as “Stormwater Management and Illicit Discharge Control”.

A motion was made to amend Item 2024-172 by deleting in Sections 2 and 3 the words “Illicit Discharge Detection and Elimination (IDDE)” and inserting in their place the words “Illicit Discharge Control” which was approved.

Presented by DPW Director Dan Santos and DPW Senior Project Manager working on Special Projects Amber Unruh. First Assistant Tom LaRosa provided some clarification to Councilor questions.

2024-177 Fiscal Year 2024 Supplemental Appropriation Order for the Operating Budget of the Town Clerk in the amount of $35,000 for the purpose of covering election costs

2024-178 Order amending Chapter 183 of the General Ordinances to provide the maximum property tax work-off amount for seniors and veterans authorized by state law

2024-179 Appropriation Order in the amount of $15,000 to fund a Finfish and Shellfish Survey Project in Barnstable Harbor

2024-180 Fiscal Year 2024 Supplemental Appropriation Order for the Operating Budget of the Information Technology Department in the amount of $203,000 for the purpose of migrating and hosting the Town’s Munis Enterprise Resource Planning System on the internet

2024-181 Fiscal Year 2024 Supplemental Appropriation Order for the Operating Budget of the Information Technology Department in the amount of $135,500 for the purpose of installing and maintaining a Rubrik Secure Backup Appliance

AGENDA ITEM 2024-174 Appointment to a Board/Committee/Commission: Council on Aging: Charles Coyle, as a regular member, to a term expiring 06/30/2025; Maureen Hughes, as an alternate member, to a term expiring 06/30/2026; Historical Commission: Robert Frazee from an alternate member to a full member to a term expiring 06/30/2026; Licensing Authority: Larry Decker from an alternate member to a full member position to a term expiring 06/30/2026; Sandy Neck Board: Richards French, as a regular member to a term expiring 06/30/2024; Youth Commission: Nate Ludtke, as a student member to a term expiring 06/30/2025 was referred to a second reading on 04/25/2024.

AGENDA ITEM 2024-175 Authorization to expend a Federal Fiscal Year 2023 Emergency Management Performance Grant in the amount of $20,150 from the Massachusetts Emergency Management Agency.

The item was presented by Police Chief Jean Challies. The item was approved.

 

AGENDA ITEM 2024-176 Transfer order in the amount of $57,845 to fund technical services, monitoring, and cleanup activities that resulted from the improper disposal of oil on LaFrance Avenue, Hyannis.

The item was presented by DPW Director Dan Santos. The item was approved.

 

AGENDA ITEM 2024-182 Resolve Appointing Michael White to the Regional District School Committee for the Cape Cod Regional Technical High School District.

The item was approved.

Michael White was invited to the podium.  He is a 2008 graduate of Cape Cod Tech and then started his own business.  After about four years he realized he owed his success to Cape Cod Tech. Ever since, he has been giving his time to them. He tries to give a lot back to the school in thanks for where he is in life. Mr. White received a round of applause.

 

The Town Council voted to go beyond 11:00 PM.

 

EXECUTIVE SESSION

The Town Council moved to go into executive session pursuant to G.L. c. 30A, sec. 21(a)(3) to discuss strategy with respect to litigation since a discussion in open session may have a detrimental effect on the litigating position of the Town and Town Council.  Specifically, the Council will discuss litigation strategy with respect to Park City Wind LLC’s proposed offshore renewable wind project in the Town.  The Council will not return to public session after the executive session.

 

A Special Town Council Meeting will be held on Thursday, April 11, 2024 at 6:00 PM.

 

The next regularly scheduled Town Council Meeting will be held on Thursday, April 25, 2024.
