The May 5, 2022 Meeting of the Barnstable Town Council was conducted remotely and physically closed to the public.  Alternative public access was provided through Zoom.  Town Council President Matt Levesque opened the meeting asking Town Councilor Paul Neary to lead the Pledge of Allegiance.  President Levesque offered the Moment of Silence remembering that today is the National Day of Prayer as recognized by President Biden and Governor Charlie Baker as we pray for our nation and peace in Ukraine and around the world. 

Next up was Public Comment which was followed by Council Response to Public Comment.  Due to the Capital Improvement Plan budget presentations this evening, Town Manager Mark Ells presented his Town Manager Communications for the period of April 29-May 5, 2022 electronically to the Town Council.  It can be viewed here.

The Council then acted on the minutes and provided their Communications.  President Levesque announced that NEW BUSINESS would be taken out of order.  Councilor Jennifer Cullum presented Agenda Item 2022-157 Appointments to a Board/Committee/Commission: Shellfish Committee: William Cherepon, as a Member at Large, to a term expiring 06/2025; Steamship Authority Port Council: Roland Breault, as a Town of Barnstable Representative Member, to a term expiring 12/31/2023 which was referred to a Second Reading on May 19, 2022.  Agenda Item 2022-158 Appropriation Order in the amount of $185,000 to fund the replacement of the Fleet Maintenance Lifts and Resurfacing of the Fleet Maintenance Garage Floor located at the Department of Public Works Facility on 382 Falmouth Road, Hyannis, MA was referred to a Public Hearing on June 2, 2022.  Agenda Item 2022-159 Order pursuant to M.G.L. Chapter 40A, Section 5 submitting to the Planning Board a proposed zoning amendment to amend the Separation Requirements of the Medical Marijuana Overlay District was referred to the Planning Board.  Town Manager Mark Ells invited Town Attorney Karen Nober to present the process for the Local Comprehensive Planning Committee.  Mr. Ells presented the rationale for Agenda Item 2022-185 Resolve ratifying the Town Manager’s Appointments to the Local Comprehensive Planning Committee was approved.  Prior to presentation of Agenda Item 2022-185A (bifurcated item), Town Councilors David Bogan and Jennifer Cullum recused themselves.  Resolve Ratifying the Town Manager’s Appointment to the Local Comprehensive Planning Committee did not pass. 

A couple of OLD BUSINESS items were also taken out of order.  Community Preservation Committee Chair Lindsey Counsell, along with Ed Pesce and J.D. Stone representing Barnstable Little League, and Assistant Town Attorney Kate Connolly presented Agenda Item 2022-152 Appropriation and Transfer Order in the amount of $200,000 in Community Preservation Act Open Space/Recreation Funds for the construction of a new restroom facility at the Little League Baseball Field Complex located at the Barnstable Innovation School, 165 Bearses Way, Hyannis, MA, Map 309, Parcel 008 which was approved.  Town Councilor Jessica Rapp Grassetti recused herself from the next item.  Mr. Counsell returned with Jennifer Loughran and Pamela Morrill of the Cotuit Federated Church to present Agenda Item 2022-153 Appropriation and Transfer Order in the amount of $179,369 in Community Preservation Funds to Cotuit Federated Church for restoration and preservation work to the buildings located at 40 School Street, Cotuit, MA, Map 035, Parcel 050 which was approved.  Town Councilor Jennifer Cullum presented Agenda Item 2022-155

Appointments to a Board/Committee/Commission: Old King’s Highway Historic District Commission: Wendy Shuck, as an alternate member to a term expiring 6/2025 which was approved.  Due to a procedural oversight, the Public Hearings for Agenda Items 2022-152 and 2022-153 were not opened.  To rectify this, and because both items had been voted, the items were each moved and approved for reconsideration.  Councilor Rapp Grassetti recused herself from item 2022-153.  The Public Hearings for each item were opened and closed.  There was no public comment on either item.  Both items were then voted on separately and were approved.  Assistant DPW Director Rob Steen with Water Pollution Control Supervisor Andrew Boule presented Agenda Item 2022-087 Appropriation and Loan Order in the amount of $11,000,000 for the purpose of funding the 720 Main Street Pump Station Replacement Project as outlined in the Fiscal Year 2023 Fiscal Year 2027 Capital Improvement Plan which was approved.  Superintendent Meg Mayo-Brown, joined by Director of Facilities for Barnstable Public Schools Michael Lambros and Deputy Finance Director Gareth Markwell, presented Agenda Items 2022-121 Appropriation and Loan Order in the amount of $4,156,984 for the purpose of funding the Barnstable High School and Barnstable Intermediate School Roof Top Unit Ventilator Replacement Project as outlined in the Fiscal Year 2023 – Fiscal Year 2027 Capital Improvement Plan; 2022-122 Appropriation and Loan Order in the amount of $1,000,000 for the purpose of funding the School Department Door and Window Replacement Project as outlined in the Fiscal Year 2023 – Fiscal Year 2027 Capital Improvement Plan; 2022-123 Appropriation Order in the amount of $650,000 for the purpose of funding the Barnstable West Barnstable, Barnstable Community Innovation School and Centerville Elementary School Emergency Generator Project as outlined in the Fiscal Year 2023 – Fiscal Year 2027 Capital Improvement Plan; 2022-124 Appropriation and Loan Order in the amount of $1,622,000 for the purpose of funding the Barnstable High School Tennis Court Replacement Project as outlined in the Fiscal Year 2023 – Fiscal Year 2027 Capital Improvement Plan; 2022-125 Appropriation Order in the amount of $60,000 for the purpose of funding the School Department Transportation and Facilities Fuel Pump and Vehicle Lift Replacement Project as outlined in the Fiscal Year 2023 – Fiscal Year 2027 Capital Improvement Plan; 2022-126 Appropriation Order in the amount of $350,000 for the purpose of funding the School Department Campus Wide Paving and Sidewalk Repair Project as outlined in the Fiscal Year 2023 – Fiscal Year 2027 Capital Improvement Plan; 2022-127 Appropriation Order in the amount of $250,000 for the purpose of funding the School Department Campus Wide Mechanical Upgrades Project as outlined in the Fiscal Year 2023 – Fiscal Year 2027 Capital Improvement Plan; 2022-128 Appropriation Order in the amount of $100,000 for the purpose of funding the School Department Campus Wide Flooring Replacement and Upgrade Project as outlined in the Fiscal Year 2023 – Fiscal Year 2027 Capital Improvement Plan; and 2022-129 Appropriation Order in the amount of $300,000 for the purpose of funding the School Department Electric Utility Transformer Upgrade Project as outlined in the Fiscal Year 2023 – Fiscal Year 2027 Capital Improvement Plan which were all approved.  Cape Cod Gateway Airport Manager Katie Servis presented Agenda Items 2022-130 Appropriation and Loan Order in the amount of $978,000 for the purpose of funding the replacement of the 1992 Aircraft Rescue and Fire Fighting Class IV Vehicle with High Reach Extendable Turret Project as outlined in the Fiscal Year 2023 – Fiscal Year 2027 Capital Improvement Plan; 2022-131 Appropriation Order in the amount of $105,000 for the purpose of funding the Airport’s Reporting, Testing, Mitigation, Monitoring Perfluorooctane Sulfonate (PFOS Soils) Phase IV Project as outlined in the Fiscal Year 2023 – Fiscal Year 2027 Capital Improvement Plan; 2022-132 Appropriation Order in the amount of $1,004,000 for the purpose of funding the Per-and Polyfluoroalkyl Substances (PFAS) Mitigation Design and Implementation Project as outlined in the Fiscal Year 2023 – Fiscal Year 2027 Capital Improvement Plan; and 2022-133 Appropriation and Loan Order in the amount of $1,200,000 for the purpose of funding the Airport’s Design and Construction of the replacement of the Circa 1997 Mo-Gas and Diesel Fuel Con-Vault, Gas Boy and Alarm and Emergency Generator Project as outlined in the Fiscal Year 2023 – Fiscal Year 2027 Capital Improvement Plan which were all approved.  The next regularly scheduled Town Council Meeting will be held on Thursday, May 19, 2022.
